General terms and conditions

1. General

These general terms and conditions apply to the sale of products and services published in the catalogs and on the website of Exact Designs, Sebastjan Zorko sp (hereinafter: Online Store).

General terms and conditions are available on the websites https://www.exactdesigns.si, https://store.exactdesigns.si/

Therefore, any consumer who places an order on the website is deemed to be familiar with their full text. By placing an order in any form, you are deemed to fully accept these general terms and conditions. The contract may only be concluded in the Slovenian language.

2. Ordering products

You can order products from us without any risk. You can view the products in the comfort of your own home and if they do not suit you, you can simply return them with a return form (RMA) and invoice (see product returns).

3. Execution or rejection of the order

Accepted orders are considered irrevocable. We will begin the activities necessary to fulfill accepted orders as soon as possible. The online store may reject an order if it determines that it cannot fulfill it under the stated conditions.

3.1. Ordering online

a. Order in the queue:

After successfully submitting your order, you will receive an email notification that the order has been accepted for processing, and you may also receive an SMS.

b. Order shipped:

In case of missing data, we will contact you by e-mail or by phone, which is listed in the contact information. The completed order will receive the status of shipped order and thus the contract for the purchase of the ordered items between the buyer and the provider is officially concluded. You will receive a notification by e-mail, you can also receive an SMS.

c. Product in stock: Whether the product is in stock or when the next delivery of the product is scheduled can be seen on our website.

d. Order confirmed: The order will be shipped to the logistics center. All products that are in stock during the order processing and package preparation phase will be shipped within 14 days at the latest. If the products are not shipped within this time, please call us at 070-547-095 or send us an email with a question.

4. Product delivery

The ordered products will be prepared and shipped to your address within the specified timeframe. The invoice you receive after placing the order includes all information regarding the warranty period for electronic products. The invoice serves as proof of warranty. It is not possible to change the billing details after the order has been placed.

Products are delivered via our contracted delivery partners in appropriate packaging. If you are not available at the time of delivery, the courier will leave a notification of the shipment or contact you regarding redelivery options. The parcel can also be collected at the carrier’s service points or parcel lockers.

Shipping and Delivery Costs

Shipping costs are calculated based on the total weight of the ordered products. The exact shipping price is automatically calculated during checkout based on the package weight and the destination country.

The final shipping cost is always clearly displayed before completing the order.

Packaging costs are included in the shipping price. Any additional costs (e.g. cash on delivery – COD fees) are not included in the base shipping price.

Delivery Time

We will make every effort to deliver the ordered goods within the standard delivery time:


  • Slovenia: 3–5 business days

  • Other countries: 5–16 business days

If the order cannot be shipped within the legally defined period of 45 days (e.g. due to delayed payment), we will inform you in a timely manner and provide a new estimated delivery time.

If the goods cannot be delivered even within the additional timeframe, you have the right to withdraw from the contract. In such case, we will refund all payments received as soon as possible, but no later than 14 days from receiving your withdrawal notice.

Regardless of the above, you may also withdraw from the contract without granting an additional period if you explicitly informed us prior to concluding the contract that the delivery time is an essential element of the contract.

5. Sold out products

In some cases, we may not be able to deliver a particular product to you because it is out of stock (when you do not pay within 48 hours of the invoice). We ask for your understanding. We are confident that you will find a replacement product in our wide range of products. If the product is not available within the legally required 45 days, we will refund your money.

6. Product pickup at Exact Designs headquarters

Products can also be picked up at the company headquarters Oblikovanje in prodaja Exact Designs, Zorko Sebastjan sp, Janžev Vrh 44a, 9252 Radenci, where you have the opportunity to personally inspect the product. For products that are paid for upon pickup at the company headquarters, the 14-day return period does not apply. In the case of products that were previously paid for online, the right to return within 14 days applies.

7. Prices

All prices listed are expressed in euros and include value added tax. VAT payers must provide their identification number and full company name when placing an order. Due to the daily updating of prices and stock and images on the website, errors may occur, which we cannot influence and are not responsible for. In the event of a significant deviation in prices or technical data, we will notify you of a change to your order. The prices on our website on the day of purchase are valid. We are not responsible for the prices of products on other websites of our partners.

8. Payment method

You can pay for ordered products in the following ways through our online store:

cash on delivery

In this case, you pay for the goods with cash or card. Additional delivery cost €1.99.

payment with Stripe credit or debit cards,

payment with Apple pay or Google pay,

payment by invoice (we will send you the invoice by email).

The invoice is valid for up to 24 hours, after which we no longer hold the stock. When paying for the invoice, please be sure to include the reference, which is the order number.

Payment with Paypal. You can also pay for the product with a Paypal account.

Paypal.com is a provider of secure e-payments with credit cards.

SEPA direct debit payments.

For exact instructions on how to exercise service, warranty, or withdraw from the contract, please contact us by email. The purchase contract (order) is stored in electronic form on the provider's server and is accessible to the buyer at any time in his mailbox. We also reserve the right to deliver only against payment of the pro forma invoice. We charge statutory default interest for untimely settled obligations. In the event of a delay in payment, we will also charge you the costs of reminders and all costs of collecting outstanding obligations, which also include attorney's fees, court fees, and other fees.

By ordering products, you agree and, upon the occurrence of a delay in payment, you expressly authorize your agent and, upon his authorization, his agent to obtain all necessary information about your assets and to conduct all inquiries relating to your accounts with banks and other financial institutions and inquiries about employment, as well as to allow the online store and, upon his authorization, his agent to forward this information to other legal entities for the purpose of recovering claims that the online store may have against you due to your unpaid obligations for the ordered products.

9. Reservation of title

We reserve ownership of the products sold and they remain the property of our online store even after they have been delivered to you, until you have paid for them in full.

10. Warranty

The invoice received serves as a warranty document and provides a warranty period of 6 to 24 months, depending on the type of product. The warranty applies exclusively to selected electronic products, such as lamps, wireless chargers and other comparable items in our offer.

The warranty does not apply to accessories and consumables - such as blades for robotic lawnmowers, accessories for robotic lawnmowers, covers, brackets, protective covers, etc. - as these are parts that are subject to intense wear and mechanical influences from the environment and uncontrolled forces during machine operation, as well as the diversity of each individual garden.

"Quality guarantee" applies where specifically stated and refers to the quality of the material. These materials are designed for a long life and can easily last up to 8 years under normal conditions of use, even when exposed to UV rays and weather conditions.


Upon purchase, you will also receive a warranty statement, which lists the general terms and conditions, the duration, and what the warranty coverage includes.

The warranty begins on the day you receive the goods. To claim the warranty, you will need an invoice and, if necessary, a warranty service certificate.

Do you have an unconfirmed warranty card? Don't worry - in accordance with Article 18 of the Consumer Protection Act, the seller's signature is not required, the invoice is sufficient.

If the repair of the product takes more than 45 days (or 30 days for products first placed on the market), we will replace the product with a new one, or if this is not possible, we will refund the full purchase price.

10.1 Legal guarantee or lack of conformity of goods Article 71 (seller's liability for lack of conformity of goods)

The seller shall supply the consumer with goods that meet the requirements of Articles 72, 73 and 74 of this Act, where applicable, and shall be liable for any lack of conformity of the goods at the time of delivery. Article 72 (subjective requirements for conformity of goods) Goods shall be in conformity with the sales contract in particular where applicable:

1. corresponds to the description, type, quantity and quality and has the functionality, compatibility, interoperability and other properties as required in the sales contract;

2. it is suitable for the specific purpose for which the consumer needs it and which the consumer informed the seller of at the latest upon conclusion of the sales contract, and the seller agreed to it;

3. is supplied with all accessories and instructions, including installation instructions, as specified in the sales contract, and

4. is up-to-date as specified in the sales contract. Article 73 (objective requirements for conformity of goods) In addition to meeting the requirements of the previous article, the goods must also:

1. be fit for the purposes for which goods of the same type are normally used, taking into account, where appropriate, other regulations, technical standards or, in the absence of such technical standards, industry codes of conduct applicable to the sector concerned;

2. be of such quality and correspond to the description of the sample or model made available to the consumer by the seller before the conclusion of the sales contract, where appropriate;

3. be supplied with such accessories, including packaging, installation instructions or other instructions, as the consumer can reasonably expect to receive, where appropriate, and

4. be of such quantity and have such characteristics and other properties, including those relating to durability, functionality, compatibility and safety, as are usual for goods of the same type and which the consumer can reasonably expect, having regard to the nature of the goods and taking into account any public statement made in advertising or labelling by or on behalf of the seller or other persons in the preceding links of the contractual chain, including the manufacturer, unless the seller proves that:

- he was not aware of the public statement and could not reasonably be expected to be aware of it,

- the public statement was corrected in the same or comparable manner as it was given by the time the sales contract was concluded, or

- the public statement could not have influenced the decision to purchase the goods. Article 74 (objective requirements for the conformity of goods with digital elements) (1) In the case of goods with digital elements, the seller shall ensure that the consumer is informed of updates, including security updates, that are necessary to maintain the conformity of the goods with digital elements, and that these updates are also supplied to him within the period:

- which the consumer can reasonably expect, having regard to the type and purpose of the goods and digital elements and taking into account the circumstances and nature of the contract, where the sales contract provides for a one-off supply of digital content or a digital service, or

- two years from the supply of goods with digital elements, where the sales contract provides for the continuous supply of digital content or a digital service over a specified period, or

- in which the digital content or digital service is to be supplied in accordance with the sales contract, where the sales contract provides for the continuous supply of the digital content or digital service for a period exceeding two years. (2) Where the consumer fails to install the updates supplied in accordance with the previous paragraph within a reasonable time, the seller shall not be liable for the lack of conformity resulting solely from the failure to carry out the relevant update, provided that:

- the seller informed the consumer about the availability of the update and the consequences if the consumer does not install it, and

- the reason for the consumer not installing the update or installing it incorrectly was not the defective installation instructions provided to the consumer. Article 75 (discharge of the seller's liability for non-conformity of the goods) The seller is not liable for non-conformity of the goods resulting from failure to meet the objective requirements for conformity of the goods referred to in Article 73 of this Act and the previous Article, if the seller specifically informed the consumer at the time of conclusion of the sales contract that an individual property of the goods deviates from the objective requirements for conformity referred to in Article 73 of this Act and the previous Article, and the consumer expressly and separately accepted this deviation at the time of conclusion of the sales contract. Article 76 (non-conformity due to incorrect installation)

(1) If installation is an integral part of the sales contract and is carried out or is the responsibility of the seller, any lack of conformity resulting from incorrect installation of the goods shall be considered a lack of conformity of the goods.

(2) If the consumer installs the goods that he has to install himself incorrectly due to defective installation instructions provided by the seller or, in the case of goods with digital elements, by the seller or the undertaking supplying the digital content or digital service, any lack of conformity resulting from the incorrect installation of the goods shall be considered a lack of conformity of the goods. Article 77 (rights of third parties) Where a restriction resulting from an infringement of the rights of a third party, in particular intellectual property rights, prevents or restricts the use of the goods in accordance with Articles 72, 73, 74 and 75 of this Act, the consumer shall be entitled to warranty claims due to the lack of conformity of the goods in accordance with this Chapter, unless another law provides for the nullity or rescission of the sales contract due to the infringement of the rights of third parties. Article 78 (warranty period)

(1) The seller is liable for any lack of conformity of the goods that exists at the time of delivery of the goods and that becomes apparent within two years of delivery of the goods.

(2) The previous paragraph shall also apply to goods with digital elements, without prejudice to the first paragraph of Article 74 of this Act.

(3) In the case of goods with digital elements where the sales contract provides for the continuous supply of digital content or a digital service over a specified period, the seller shall be liable for any lack of conformity of the digital content or digital service which arises or becomes apparent within two years of the supply of the goods with digital elements.

(4) In the case of goods with digital elements where the sales contract provides for the continuous supply of the digital content or digital service for a period exceeding two years, the seller shall be liable for any lack of conformity of the digital content or digital service which arises or becomes apparent during the period during which the digital content or digital service is to be supplied in accordance with the sales contract.

(5) If the subject of the sales contract is second-hand goods, the seller and the consumer may agree on a shorter period of the seller's liability than that specified in paragraphs one to four of this Article, but this period may not be shorter than one year. 8 Article 79 (prohibition of limitation or exclusion of liability)

(1) A contractual provision may not limit or exclude the seller's liability for lack of conformity of goods as provided for in this Act.

(2) Any contractual provision that contradicts the preceding paragraph shall be null and void. Article 80 (General Provisions)

(1) It shall be presumed that the lack of conformity of the goods already existed at the time of delivery if it becomes apparent within one year of the delivery of the goods, unless the seller proves otherwise or if this presumption is incompatible with the nature of the goods or the nature of the lack of conformity.

(2) In the case of goods with digital elements where the sales contract provides for the continuous supply of digital content or a digital service during a specified period, the seller shall bear the burden of proof as to whether the digital content or digital service was in conformity during the period referred to in the third and fourth paragraphs of Article 78 of this Act, if the lack of conformity becomes apparent during that period. Article 81 (Warranty claims and other consumer rights)

(1) In the event of non-conformity of the goods, the consumer who has notified the seller of the non-conformity of the goods is entitled, under the conditions and in the order set out in this section, to: 1. request the seller to bring the goods into conformity free of charge; 2. request a reduction in the purchase price in proportion to the non-conformity or withdraw from the sales contract and request a refund of the amount paid.

(2) The consumer may withhold payment of the remaining part of the purchase price or part of that remaining part of the purchase price until the seller has fulfilled his obligation under this section. The consumer shall exercise this right by making a statement informing the seller of his decision.

(3) In any case, the consumer also has the right to demand compensation from the seller for damages, in particular reimbursement of the costs of materials, spare parts, work, transfer and transportation of goods, which arise as a result of exercising the warranty claim referred to in the first paragraph of this Article. Article 82 (establishment of conformity)

(1) The consumer may require the seller to bring the goods into conformity free of charge and without significant inconvenience to the consumer within a reasonable period of time from the moment of informing the seller of the lack of conformity, which shall not exceed 30 days, taking into account in particular the nature of the goods and the purpose for which the consumer requires the goods. (2) The period referred to in the previous paragraph may be extended to the shortest time necessary to complete the repair or replacement, but not more than 15 days. When determining the extended period, the nature and complexity of the goods, the nature and seriousness of the lack of conformity and the effort required to complete the repair or replacement shall be taken into account. The seller shall inform the consumer of the number of days for which the period may be extended and the reasons for its extension before the expiry of the period referred to in the previous paragraph.

(3) The conformity of the goods shall be deemed to have been established free of charge if the seller also bears the payment of the necessary costs incurred in establishing the conformity of the goods, in particular the costs of shipping, transport, labour or materials. (4) In order to establish the conformity of the goods, the consumer may choose between repair of the goods and replacement of the goods with new, faultless goods, unless: - the fulfilment of the selected warranty claim is impossible or - the fulfilment of the selected warranty claim represents disproportionate costs for the seller compared to another warranty claim, taking into account all the circumstances.

(5) The circumstances referred to in the second indent of the previous paragraph are, in particular, the value that the goods would have had if they were not non-conforming, the significance of the non-conformity and the possibility of securing another warranty claim for the consumer without significant inconvenience.

(6) The seller may reject the consumer's warranty claim for the establishment of conformity of the goods if repair and replacement are not possible or if they would cause him disproportionate costs, taking into account all circumstances, including those referred to in the previous paragraph.

(7) Where the repair or replacement of the goods is necessary to restore conformity, the consumer shall make the goods available to the seller. Where the replacement of the goods is necessary to restore conformity, the seller shall take back the replaced goods at his own expense.

(8) Where goods which were installed in accordance with their nature and purpose before the lack of conformity became apparent must be removed for the purposes of repair or replacement of the goods, the obligation to repair or replace the goods shall also include the removal of the non-conforming goods and the installation of replacement or repaired goods or the covering of the costs of such removal and new installation.

(9) The consumer is not required to pay for the normal use of the replaced goods in the period prior to the replacement. Article 83 (reduction of the purchase price and withdrawal from the sales contract) 9

(1) The consumer may request a proportional reduction of the purchase price or withdraw from the sales contract in any of the following cases: - the seller has not repaired or replaced the goods or, where applicable, has not completed the repair or replaced the goods in accordance with this Act or has rejected the consumer's warranty claim for the establishment of conformity of the goods in accordance with the sixth paragraph of the previous article; - the lack of conformity exists even though the seller has attempted to establish conformity; - the nature of the lack of conformity is so serious as to justify an immediate proportional reduction of the purchase price or withdrawal from the sales contract, or - the seller has stated or it is obvious from the circumstances that the seller will not establish conformity of the goods within a reasonable time or without significant inconvenience to the consumer.

(2) Notwithstanding the previous paragraph, the consumer may withdraw from the sales contract and request a refund of the amount paid if the lack of conformity occurs within less than 30 days of the delivery of the goods.

(3) If the consumer requests a proportional reduction in the purchase price, the reduction in the purchase price shall be proportional to the reduction in the value of the goods received by the consumer compared to the value that the goods would have had if they were in conformity. (4) The consumer shall exercise his right to withdraw from the sales contract by means of a statement informing the seller of his decision to withdraw from the sales contract.

(5) Where the lack of conformity relates only to part of the goods supplied under the sales contract and there is a ground for withdrawal from the sales contract in accordance with the first or second paragraph of this Article, the consumer may withdraw from the sales contract in respect of those goods and any other goods acquired together with the non-conforming goods, if the consumer cannot reasonably be expected to retain only the goods which are in conformity. (6) Where the consumer withdraws from the sales contract, the consumer shall return the goods to the seller at the seller's expense. (7) The consumer may not withdraw from the sales contract if the lack of conformity is only minor. The burden of proof as to whether the lack of conformity is minor shall lie with the seller. Article 84 (Notice of lack of conformity and inspection of the goods)

(1) The consumer may exercise his rights arising from a lack of conformity if he notifies the seller of the lack of conformity within two months from the date on which the lack of conformity was established.

(2) The consumer shall describe the non-conformity in detail in the notice of non-conformity.

(3) The consumer may notify the seller of the lack of conformity in person, of which the seller shall issue a receipt, or may send it to the store where the goods were purchased, or may notify the seller's representative with whom he concluded the sales contract.

(4) The consumer shall enable the seller to inspect the goods which the consumer claims to be non-conforming. Article 85 (existence of non-conformity) If the existence of non-conformity of the goods is disputed, the seller shall inform the consumer thereof in writing within eight days of receipt of the consumer's warranty claim. Article 86 (deadline for refund of the amount paid or part of the purchase price)

(1) Where the consumer withdraws from the sales contract, the seller shall refund the amount paid to the consumer immediately, but no later than eight days after receipt of the goods or proof that the consumer has sent the goods back.

(2) Where the consumer requests a proportional reduction of the purchase price in accordance with the third paragraph of Article 83 of this Act, the seller shall refund part of the purchase price within eight days of receiving the request for a proportional reduction of the purchase price. Article 87 (loss of rights) The rights referred to in the first paragraph of Article 81 of this Act shall expire within two years of the date on which the consumer notified the seller of the lack of conformity of the goods.

11. Data protection and accessibility

Your personal data will be carefully protected in accordance with applicable regulations. The data obtained when ordering goods and using the website will be used to send informational materials, current offers, invoices and other necessary communications between you and the online store.

12. Out-of-court dispute resolution and other legal remedies

Exact Designs makes every effort to resolve any disputes amicably, but if this is not possible, the court in Ljutomer will have jurisdiction to resolve such disputes. In accordance with Article 32 of the Out-of-Court Dispute Resolution Act (ZIsRPS), Design and Sales Exact Designs, Zorko Sebastjan sp, does not recognize the jurisdiction of IRPS providers to resolve consumer disputes that the buyer may initiate in accordance with this Act. The buyer may also file a complaint on the EU platform for online consumer dispute resolution (SRPS).
